I am familiar enough with the MNPPA that I know even if the store isn't posted and they want you to leave, staying is trouble.

Here's my question. Lets say you are concealing and they don't notice, you order your plate of pancakes and a cup of coffee. After eating your pancakes you sit and chat while taking advantage of the free refills, and you take off your outer shirt revealing your gun.

Managment comes up to you and asks you to leave.

Can you legally just stand up and walk out, or are you required to pay for the food. What if the meal is not finished?

Legal or not, I think the right thing to do is to pay for your food.

IANAL, but I agree with bstrawse. If I were still in the middle of the meal, I'd politely ask for it to be wrapped up to-go. if the food hadn't gotten to the table yet, then I'd pay for any beverages I've had and not for the food (or see if it's almost ready and if so, have it set up to-go).

It's great to be extra polite about it, but also loud enough so that the rest of the customers around you get informed what is going on and see that you're being so polite and they're throwing you out over carrying a tool - makes the restaurant manager look dopey! If it ever happens to me, I hope I'll say something like "I'll happily leave since you insist, but I don't understand what all the fuss is about over someone carrying a simple tool for their own personal protection. What is it about self-defense that makes you so uncomfortable?" :twisted: who knows - asking the question might lead to a positive conversation and potential converts - if not them, maybe other patrons nearby.

If you haven't finished your meal, and they ask you to leave, just leave. When you buy a meal at a restaurant, you are paying for the food, the table service, the plate, the fork, the spoon, the refills, and the seat. If they don't want to sell that to you, there's no reason to pay for it.

Reasonably, however, if you're done eating anyway, you should pay.

The last thing we need is word to get out that people show their guns in order to dine and dash.

Perkins in Maplewood (just south of the Ramsey County Farm and golf course) had a sign up (No Guns) but that was taken down over a year ago.

They do have other issues however: When asked a few months ago why my steak was not prepared as I had asked (topped off with Lawry's, garlic bits, and worchestershire sauce) the waitress (a morning stalwart who has been there for years) enlightened me that the menu notation "prepared to order" meant that they prepare the steak as the cook wants, not as the patrons desire. (Not a joke.) When I asked if the same statement used in the menu for eggs meant that the cook would select either poached, scrambled, over easy, etc, for each patron, she just walked away without saying a word.

An email to the home office elicited sympathy, but then I received a phone call from the store manager who told me that their cook had been with them for years, knows how to prepare steaks, and that my patronage would not be welcome any longer.

I wouldn't recommend Perkins to my worst enemy, whether they accept those that carry or not.

Nope. Not that I particularly give a shit about debate as long as they change the rotten policy. Their food has been crap for awhile now anyways. I end up there only because I have family that seems to think it's good.

But at least my family understands, and is willing to meet up elsewhere a couple times a month.

Well I think we all (and those on THR) had a positive impact.

I just got a call from Bill at Perkins (I honestly don't know if he's the regional manager mentioned earlier). He says he's talked with several of us and admits that we "brought some things to light" that they hadn't considered. He says that, prior to this incident, they really had no policy concerning firearms. Now that they understand where we're coming from, he says they aren't going to have a policy stating they're for carry or against it but rather will consider the individual circumstances.

I reemphasized the requirements for legal carry, that a lot of of us understand the potentially dire repercussions of using a firearm when not warranted, that it's not a tool for intimidation, that we do understand that crowded restaurants present lots of challenges to safely using a firearm, that more people carry than he likely realized before this incident, that lots of us don't carry because we expect something bad to happen at dinner or wherever we're going, but that occasionally bad things do happen even in family neighborhood restaurants (a subtle allusion to Suzanna Hupp's experiences). I didn't raise the topic of open carry, but Bill did specifically use the phrase "but if it's coming out of it's secure holster," when talking about looking at the individual circumstances. So I suspect that a decent looking person OCing might just pass muster, at least with him, if not the local store staff.

I'm pretty sure everything I said above is accurate, but it's from my memory. I didn't record the call. Hopefully, others are getting the same message.

In light of this, I'll tell the family that we CAN meet them at Perkins next time.
