Post subject:  Another Open Carry Picnic Scheduled

I had meeting this week with the local authorities; i.e. Mayor and Police Chief and got everything addressed to their satisfaction, we’re good to go for the open carry picnic!

The primay purpose for this Open Carry Picnic is to exercise our 2nd Amendment rights and to educate the general population,
as well as elected officials, on the legality of carrying a firearm for personal protection.

Mark your calendars for Noon to 4:00 pm on Sunday Aug. 23rd; it will be at the St. Croix Co. Fairgrounds in Glenwood City Wisc.

We will be publishing a flyer in the next several days with all the details, this is a great step forward.

Minnesota residents welcome; just make sure you follow Wisconsin law; concealed carry not allowed

Looking forward to seeing everyone there; and spread the word!!

GUIDE LINES:

• All firearms must be unloaded and encased during vehicle transport as required by Wisconsin State Law.
• Firearms should be transported in a non-passenger area of the vehicle if possible.
• Firearms cases must be completely removed from the vehicle before being opened.
• All firearms MUST REMAIN HOLSTERED at all times, except for what is required for vehicle transport.
• All Wisconsin concealed carry restrictions and prohibitions apply.
• Only those 18 years of age and older may possess a firearm.
• ALL firearms safety rules MUST be followed.
• If somebody says, "can I see your firearm," simply turn and show them your holstered firearm. DO NOT REMOVE FROM HOLSTER!
• Please leave long guns at home.
• No alcohol or drugs permitted.

Reminder to anyone from MN planning to attend...you may NOT have the gun loaded or uncased while in your vehicle in WI. That means it stays cased, unloaded (and please keep it in the trunk / rear if you don't have a trunk). Get to the site, THEN holster up.

Yup, it's a pain for us Gophers...but it's a chance to help our neighbors across the way.

I thought that WI law did not allow carry in a vehicle other than unloaded and in a case. I dunno about the trunk aspect. I realize the query was not directed to me, however. I would be interested in the reply........

They do not allow vehicle carry other than unloaded and in a case, to my knowledge...

Trunk, as far as I can tell by statute, not required, BUT...

From someone who spent 28 years living in that state, and owned guns there:

You will have a much easier time if stopped by law enforcement if the gun is well out of your reach. If you want to be a test case, yup, the law is on your side. Remember, WI cops are likely far less educated as to carry laws than are MN cops, and we know how hit-or-miss that can be. :shock:

In short; here is what the Statute says:

Contrary to popular belief; there is no stipulation on the firearm not being in the passenger portion of the vehichle.

(2) PROHIBITIONS; MOTORBOATS AND VEHICLES; HIGHWAYS AND
ROADWAYS. (a) Except as provided in sub. (4), no person may
place, possess or transport a firearm, bow or crossbow in or on a
motorboat with the motor running, unless the firearm is unloaded
or unless the bow or crossbow is unstrung or is enclosed in a carrying
case.
(b) Except as provided in sub. (4), no person may place, possess
or transport a firearm, bow or crossbow in or on a vehicle,
unless the firearm is unloaded and encased or unless the bow or
crossbow is unstrung or is enclosed in a carrying case.
(c) Except as provided in sub. (4), no person may load or discharge
a firearm or shoot a bolt or an arrow from a bow or crossbow
in or from a vehicle.
(d) Except as provided in sub. (4) (a), (bg), (cg), (e), and (g),
no person may discharge a firearm or shoot a bolt or an arrow from
a bow or crossbow from or across a highway or within 50 feet of
the center of a roadway.
(e) A person who violates pars. (a) to (d) is subject to a forfeiture
of not more than $100.


The exceptions referenced basicly give exemption to law enforcement and active Military.

Yup. That's the one!

I'm quite paranoid, after a run in with WI state patrol years ago. Remember, the law may be prevent you from being convicted, but it doesn't mean they can't make your life a living hell while figuring out whether to arrest you / charge you or not.

Open-carry picnic set at Glenwood City

GLENWOOD CITY - Glenwood City Police Chief Robert Darwin said he's not overly concerned about hundreds of people coming to the St. Croix County Fairgrounds on Aug. 23 armed with loaded sidearms.

"I don't have a problem with what they want to do," he said. "They have the lawful right to do that.

"My concern is how the general public will respond," Darwin said Wednesday. "I hope they will respect it, since it is lawful. The people coming to this are not the kind of people we need to worry about."

Dave "Ole" Olson said he and his wife, Annette, organized the "Open Carry Picnic" from noon to 4:30 p.m. at the fairground primarily to inform people of their Second Amendment right to openly carry sidearms.

He plans to hold another event in a few months in Hudson related to First- and Second-Amendment rights, with a nationally-recognized guest speaker.

"This is important to me because it has to do with our liberties," he said. "Our passion is liberty and freedom. In my thinking, the country is going in the wrong direction and people need to know that they have the right to carry a gun."

Olson said the effort is not sponsored by any group, and said he is spending about $2,000 of his own money for food to handle about 400 people, including barbecue beef sandwiches, beans, coleslaw and other food items.

The event is open to the public. A freewill offering will help cover the costs, and people are encouraged to bring a dish to pass. Sidearms are not required to attend.

"The purpose of this is, for the general public and the gun owners alike, education," he said. "I can't believe the number of people who don't know the law."

Similar events have been held at other locations in the state, including Onalaska and last weekend in Green Bay.

Firearms may be loaded but must be holstered at all times at the site. Only people 18 or older may possess a firearm, and no long guns or alcohol will be permitted at the site.

Olson said he actually is not an advocate for the open carry law,

"I am not an advocate of open carry for several reasons; one being that it does give a certain discomfort level to some people," said Olson, a construction contractor.

Olson has invited numerous legislators and officials, including St. Croix County Sheriff Dennis Hillstead.

"He did extend an invitation for me to stop by, but I'm not sure if I will or not," Hillstead said. "I believe it is a way for people to test municipal ordinances against what the state law is."

Chief Darwin said Glenwood City's ordinance regarding handgun possession was "basically unenforceable" based on an April 20 decision by state Attorney General J.B. Van Hollen.

Darwin said people were receiving disorderly conduct citations for carrying a weapon, but the law states there must be extenuating circumstances or unlawful acts along with carrying the weapon.

Darwin said there will not be a great police presence, in part because budget cuts reduced the police department from three full-time and four part-time officers to only two full-time officers.

"I don't anticipate any problems," he said. "After all, these are the people who came and told us about what they plan to do."

Dick Sullwold, president of the St. Croix County Fair Board, said Wednesday that he had no issues with renting out a portion of the fairgrounds for the event.

"As for me renting out the facilities, I would do it for most any event," he said, adding that it will cost $150 for an outdoor event or $200 if the event is held inside a building on the grounds because of inclement weather.

Sounds like the sheriff doesn't understand the concept of preemption.

And it sounds like that police chief has a decent head on his shoulders!

One of the replies to the Leader Telegram article reads, in part:

«... what if something happens and someone gets shot or killed?»

What is WRONG with people? Do they think we are planning to set up beer cans and have target practice? Why are people afraid of law abiding citizens exercising their rights? I just don't get it, I really don't.

Yes they do, passed in 1995 when, ironically, Doyle was A.G.
