I have lived in south Minneapolis since august and I have been robbed twice. I am looking into getting a pistol and MN concealed carry permit, but I have some offenses on my record that I fear will disqualify me from getting one. I have 1 DWI, 1 DUS, and 1 possession of marijuana paraphernalia, for which they gave me a "deferred imposition" which will remain on my record for 1 year.
I read that to get a permit in MN "you must not be a drug user." Does this apply to any and all drug offenses, or just actual posession of a controlled substance? Will the conviction prevent me from obtaining a permit after it's off my record?

1. Lawyer.
2. Even if you don't "have a problem" you might consider talking to someplace like CLUES about a CD assesment. A clean bill of health on a recent CD assesment could save you time on your appeal.
3. Were all offenses non-felony? If so you should only need a lawyer & be doing yourself a favor gettibng that CD assesment in hand or at least scheduled before starting your permit paperwork.

Marijuana paraphernalia isn't part of the rejection criteria. Neither is possession of a small amount of marijuana. They are decriminalized petty misdemeanors.

Given your history, perhaps it may be better to work a little harder on staying out of trouble.

None of those things are, in and of themselves, disqualifications (IMHO, IANAL, etc.) but the sheriff -- and the court -- will look at the whole picture, from different vantagepoints.

the charges were all non-felony and actually, my clean urinalysis and CD evaluation is the reason i got off so light on the paraphernalia charge (it happened in fargo, ND, which is much more strict than MN) so that shouldn't be a problem. thanks for the advice

If it happened in ND, I question if the local sherrif would even have this information.
One way to find out...
