We'll let the "facts" speak for themselves when the BAC is released. Hopefully an official Complaint will be forthcoming that contains the "facts" of the case albeit with an LE bias.
IF the BAC is below limit the guy has a fairly good chance (oops, that's my opinion-don't know if it's safe to express that anymore :oops: ). Still doesn't change my opinion on booze and guns, even if he comes in below the limit. If you took out the booze factor I'd support him-he took charge and stood up for the right reasons. Sounds like a good guy! I wish more people would do that-we need 'em-just leave out the booze. 'Pears I'm in the minority here but that's ok...

You're doing it wrong.

"plbbbbbbt" is the international phrase for challenging someone to a duel. Wamps, I believe you get weapon choice.

Would the BAC normally be included in the complaint if it was an issue?

From reading the police report it seems, to me, that what he did was reasonable. However, in his shoes I would have just been a good witness. If the car was close to me and mine, and I thought he was going to drive at/over us I think I would have done something similar. Maybe. If there were no other options.

But then again, I don't know the whole story here. Maybe his wife/kids couldn't run very well eliminating retreat as a viable option.

Suited, thanks for the posting.
Wonder if they even did a BAC test?? Maybe considered secondary to the main charge? Even so, a definitive BAC would've been good to have for one side or the other.

I'm surprised they didn't immediately know his BAC. OTOH, maybe they did and did not include it in the complaint because it would weaken their case.

That's the way to bet. The likelihood -- by no means a certainty, but close -- is that if they had any evidence that he was guilty of CWI, they would have charged him with that.
