Some interesting devlopments since the big hurricane.

From the National Shooting Sports Foundation newsletter I received today:

STATES HAVE DIFFERING TAKES ON EMERGENCY POWERS . . . Confiscation of firearms by the New Orleans police following Hurricane Katrina has sparked in many state legislatures debates and the introduction of legislation addressing gun owners’ rights vs. emergency police authority. In separate items in the April 27 NRA-ILA electronic newsletter appear reports on: the Louisiana state house approving an amendment to prevent New Orleans-style gun confiscations during a natural disaster; the Arizona senate narrowly failing to override the governor’s veto of a bill that would have prohibited the imposition of firearms restrictions during a declared state of emergency; and an Oklahoma state representative wanting to change the current law in his state to allow gun confiscations during emergencies.

Anyone know what they would do in an emergency here in MN?

Looks like Section 12 deals with emergencies. I searched and did not find the word 'firearm' in that section. I found 'weapons,' but it wasn't relevant to the question.

12.32 Governor's orders and rules, effect.

Orders and rules promulgated by the governor under
authority of section 12.21, subdivision 3, clause (1), when
approved by the Executive Council and filed in the Office of the
Secretary of State, have, during a national security emergency,
peacetime emergency, or energy supply emergency, the full force
and effect of law. Rules and ordinances of any agency or
political subdivision of the state inconsistent with the
provisions of this chapter or with any order or rule having the
force and effect of law issued under the authority of this
chapter, is suspended during the period of time and to the
extent that the emergency exists.

"Peacetime emergency" includes natural disaster.

It almost sounds like the Governor can declare anything he wants in an emergency and it has the full force of law. I'm not too worried about governor Tim but what if some liberal anti-gun person is in there?

I didn't dig too much into it. The section I posted said the governer's powers override any state/city/county laws.

I think what I obsorbed last night was that the governer can call for an emergency, but it only lasts 3-5 days. Then an emergency board has to rule to extend that to up to 30 days at a time.

I think maybe a priority should be "The State/County/City/Whatever can't take our Firearms when a state of emergence is declared" law :|
