Anyone catch COPS on ch. 29 tonight?

Episode 2205

Man gets arrested for shooting someoe in Vegas (?). He told PD he had a permit. He said he was hit three times in the face and told the person he shot to leave etc.

Not sure of all of the facts of the story of course but again to get a laywer would have been great advice.

I saw the episode, and the shooter had a permit, had some company over playing ping pong. He was winning, an argument happened, and the shooter got punched in the face, he asked the company to leave, they punched him a 2nd time, so he shot the guy, and got punched in the face a 3rd time. Admits everything to the cops/camera and says absolutely nothing about fear or anything like that. More like in his mind if you get punched, its OK to shoot someone.

Bad shoot. The shooter is going to jail for attempted homicide, just because he took a punch or 2 and got a bloody nose :bang:

I do like this part of the interrogation:

Cop: And how many shots did you fire?
Suspect: I wanna say it's two, but uh..
Cop: You're not sure, but you think it's two?
Suspect: Yeah
Cop: OK, all right, OK, and what happened after that?
Suspect: I stopped getting punched in the face.

Did anybody else happen to notice these things?

-The state of the "permit holder"... seemed intoxicated to me
-The calm demeanor with which the officers gained incriminating evidence. They were being so understanding.
-The fact that the shooter couldn't seem to keep his mouth shut
-The "stopping power" of the KT .32/.380

Just some observations...

Yep, lots going on there. That clip is almost a clinic on what not to do in almost every facet.

The cops was from Las Vegas so I assume he had a Nevada license.

+1 to Dean I think a lot can be learned from this video.

Notice how the "helpful" police officer slowly asks the questions to build the case.
Reluctant Participant:
"So why were you carrying the gun tonight, did you anticipate trouble?"
Immediate Danger:
"So how long between when they hit you and you fired?"
Lesser Force:
"So they hit you and then stopped, what did you do then?"

This should be required viewing. The police were doing there job, which is not to helpful but to investigate a crime and help build a winnable case - and they did a good job.

Yep. THAT was an example of "protect and serve" that more officers should be trained to live by.

Its cool you guys are discussing. I thought the guys answers were reasonable, the cop did a very good job of questioning.

Lets do a couple things, assume the guy normally carries as he said, and lets also assume everything was legit, no booze/drugs. Just another out of control ping pong game in the shooters home then public location.

What should the man with the weapon stated to the police? Do you immediatly take this to "I wont discuss anything w/out my lawyer? All I know is that I was fearing for my life"?

How should you answer why are you carrying, the guy said he has a permit and carrys often. Whats wrong with that?

The guy says he asked them to leave and they kept hitting me. Hows that play with Castle Law? He said he shot them upclose in his house. If he was in a 2v1 confrontation in his own home getting beaten it doesnt seem unreasonable to escalate force IMO.

The point being nothing he's saying is going to help his case, and taking your time to talk to/through a lawyer is in just about every case conceivable is the right and proper choice.

really, this could be the single most important piece of advice you'll ever have god forbid you're ever involved in such an event.

Anyone notice how the cop calls for an ambulance but mentions that the injury was "non-life threatening"? THE GUY HAD A HOLE IN HIS STOMACH. That looked extremely painful.

I think my instructor would not hesitate to revoke my training certificate or not allow me to take to re-cert course unless I answered:

1. I was in fear for my life

2. I do not consent to a search

3. I will not answer any more questions without my attorney present

While it was not covered in our class ( if I can remember way back then), this may also be applicable in the following situations:
- Neighbor calls police about my using an airgun to pop squirrels & chipmunks in my back yard
- Pulled over for suspected traffic violation
- Crossing in the crosswalk against a red light

YMMV
