Danville police shoot, kill growling miniature dachshund

By Staff Reports

Published: June 11, 2009

DANVILLE -- Danville's police chief says one of his officers acted properly by shooting and killing an 11-year-old miniature dachshund that ran at him while growling.

Neighbors said Killer, who died Monday night after being shot once, was a sweet, mild-mannered dog.

"He just kind of walked up and down the neighborhood and didn't bother anybody," said Jenine Edmunds, who lives on the same cul-de-sac as Killer's owners, Tawaiin Harper and his family. "He was just a little house dog."

Police Chief Philip Broadfoot declined to name the officer who shot and killed the dog while serving two outstanding warrants to a neighbor.

As the officer returned to his car, "he was surprised by a growling dog running through the yard directly at him from the rear, leaving him with just seconds to consider his options," according to the a release from Broadfoot.

The options, according to the chief: running to the squad car, distracting the dog or using pepper spray, a baton or firearm.

Broadfoot said the dog lunged at the officer and attacked him.

"Shooting a dog which is actively presenting a threat to an officer is within the department's policy," according to the release.

Harper said he drove home from work to try to comfort his wife and two children after they called to say Killer had been shot to death by the officer.

The officer's supervisor, a lieutenant, "was very, very remorseful," Harper said. "He kept apologizing. And he said, 'I know apologizing can't bring the dog back, but I just don't know what to say.' "

Harper said friends and neighbors have asked if the family will get another dog.

"You can't replace Killer. He's one of a kind. I'm still trying to soak it in because the dog had been with us so long. He was a family member. They took a family member away."

WTF. That's all I can say. WTF.

Pisses me off. Some people are a waste of oxygen, much less the tin used for their badge.

ETA - I'd love some insight (seriously, no joke, no smartass stuff meant in this question) from our LEO members about current hiring practices in the field. It seems like we are getting more and more officers with seriously screwed up senses of what is "right" vs. what is "allowed", and I'd like to know why it is getting worse.

Hey, come on! An elderly miniature wiener-dog can be deadly. I mean, his name was "killer!"

I have two of them
For those of you who don't know just how small a mini-Dachsi is; mine are about six pounds and eight pounds respectively. Eleven years is pretty old for a small dog like that.

It appears that this guy, a supposedly trained peace officer was frightened by an animal the size of a large rabbit. So apparently he's been watching too much Monty Python or he's got a cruel streak a mile wide. I'd vote for the latter because even if the dog was actively attacking him, a good boot would take care of the problem.
He felt he had to use his firearm on the dog... why? The dog wasn't respecting his Authoritah?

I have a hard time coming to grips with the fact that people like this are allowed to have law enforcement jobs.

The question they should put to the department is what would likely happen if an average guy did the same in the context of his job, like delivering something. Excepting the obvious, it's within my policy to shoot a dog which is "actively presenting a threat". If you or I had been delivering a package to the house and killed the owner's dog, and someone brought the police into the matter, I wonder how the Danville PD would have treated us.

I imagine, "It's not your property and no one's forcing you to be there. You can't just shoot someone's dog because it bothers you."

This A**hole (and those like him) must find some kind of deviant gratification from the murder of these small pocket dogs. I pray that they'll get their just deserts at the time they meet their maker.

Wow, just wow.

Anytime a 10lb "killer" dog of fury has come at me, I just usually take a step back, wait and then punt. He had seconds to think about this? Seriously? Did he look at where the bullet would go when he shot. A small dog is not going to slow a bullet down that much.

So with the police chief saying it is within 'policy' to justifiable to shoot any dog presenting a threat to officers, what does the law say? From this I could take it that it is my policy to shoot any dog that presents a threat to me, regardless of size. I have a right to defend myself and a LEO in the same situation has done the same.

I do have some rat terriers roaming the neighborhood and menacing me while I am in my yard, though they maybe only 5lbs, they are extra vicious.

Isn't that supposed to be like 77 years in "human" time? If it would have been an old female dog running away, he probably would have just tasered it.

I'm still trying to come to grips with the notion of a miniature dachshound lunging :?

Hey, if a dead kid in Minneapolis can have a gun in his hand when video says he didn't and the gun had none of his fingerprints on it, then a miniature dachshund can certainly lunge... :?

I suspect the new trend of shooting dogs may actually be a gang initiation ritual.

How about a gang strike force initiation ritual?

If anyone besides a police officer shot and killed the dog with that reasoning. They'd be in jail and the gun held as evidence "pending investigation" -

Cute pup... :(

Obviously the police chief speaks out of both sides of his mouth --
good in June, bad in July. For ordinary folks, that's called l-y-i-n-g.

Quote:
Oops, Wrong Dog: The Danville [VA] Police Department fired Officer
Murrill McLean and will discipline some of his supervisors for their
actions after McLean shot and killed a miniature dachshund named Killer
on June 8, according to a Friday news release from Police Chief Philip
Broadfoot. "This entire matter has been an embarrassment to the Danville
Police Department, the City of Danville and to me personally," Broadfoot
said. McLean's firing is an abrupt reversal of the stance the department
took on the shooting. In June, Broadfoot defended his officer's actions and said
he acted within the department's policy during two news conferences in
June...
