 If denied in MN. Can you use Utah to carry in MN?

Before any class I always bring up the possibility that depending on their local sheriff's whim, they might have to engage an attorney in the event that said sheriff denied their permit. This is AFTER I run through all the obvious things that disqualify. No point in wasting their time and money if they can't pass the check.

Then, I hand them Brian Toder's card.

Had a student who lived in St Paul who was denied on the basis of a 12yr old DUI. After weighing the costs, he decided his Mom's house was his new residence. His Mom lives in Washington Cty. :lol: :lol:

Here's what we know about timing. This is general information, not specific advice for any one person. Also, it should be noted that I'm not a lawyer, just a guy who gets asked this stuff a lot, and who has regular contact with lawyers who do this stuff.

The court must hear the appeal within 60 days of filing. The hearing will likely run an hour or two, and decisions are usually returned within 30 days.

There is a hard deadline of 20 business days to submit an administrative appeal -- a letter from you or the lawyer. If a denied applicant is considering that as an intermediate step prior to a full-blown court appeal, that deadline should be carefully noted.

Getting an administrative appeal letter written by a lawyer will cost less than a court appeal, but if the sheriff reverses himself, the sheriff will not pay the attorney for the cost fo the letter. If you go to court and win, the sheriff will be ordered to pay your legal costs.

Yup, to all of that. As a real lawyer will tell you, the admin appeal process is optional -- they have to (pretend to) go through it, but you don't.

Just one additional information.

If you have been convicted of one of the "moral" turpitude listed by Utah rules, they will let you get their permit after 5 years of clean record depending on the nature of the crime. I got this information when I took my class, but I tucked the information away as I only needed MN and ND license at that time and it did not apply to me.
